Introduction to Homecare GPS Mobile Privacy Policy

Elgon, Inc d/b/a Homecare GPS is committed to maintaining robust privacy practices for its users.  This Privacy Policy outlines the types of data that Elgon Inc. d/b/a Homecare GPS (“Company” or “We”) may collect or that you may provide when you install, access, and use the HomecareGPS Mobile Application (the “App“) or access and use the browser version located at mobile.homecaregps.net, and our practices for collecting, using, maintaining, protecting and disclosing that data.

This policy applies only to information we collect in this App and in text, email, and other electronic communications sent through this App and Homecare GPS.  This policy DOES NOT apply to information that we collect offline or on any other Company apps or websites, including websites you may access through this App; you may want to review the policies of any such site before entering.

What is Personal and Sensitive User data?

Personal and sensitive user data includes, but is not limited to, personally identifiable information (“PII”) that could potentially be used to identify a particular person such as name, address, email, etc., authentication information, device location, financial or payment information, health data, microphone, camera, inventory of apps on the device or other sensitive device or usage data.

How is information collected, used, and disclosed?

The Company is a Business Associate performing services on behalf of your Employer, who is our customer and a Covered Entity (your “Employer”). The App is a companion mobile application to the Homecare GPS web application, used by your Employer.  As such, your personally identifiable data (PII) may be provided to us by your Employer for us to provide the appropriate services in accordance with contractual obligations to your Employer. Requests to update or delete any personal and sensitive data must be coordinated through your Employer that requested you to provide and collected the information, as such requests may impair the Company’s ability to provide agreed-upon services to your Employer.

You are a permitted user of the App, as authorized and managed by your Employer. Your Employer grants your permission to access the App, manages your access to the App, assigns the information requested from you, and assigns tasks to be completed by you as a means of performing your assigned responsibilities with your Employer.

We do not collect any PII from the App without your consent.  Your Employer may request that you voluntarily supply information within the App to meet their needs or to enhance your experience.  It is up to you to provide the requested information through the completion of form fields or by selecting photos, videos or other documents to upload.  Should you choose not to provide the requested information through the App, then you may provide it directly to your Employer using alternative means.

We may request that you allow location services when the App is installed, limited to the user’s explicit capture at the start and end of patient visits as means of your Employer meeting State or Federal rules and regulations concerning electronic visit verification.

If you have voluntarily provided information, you consented to the collection and use of your personal and sensitive information as described in this Privacy Statement.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download or use this App. By downloading or using this App, you agree to this privacy policy and its practices described herein. This policy may change from time to time. Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

Information We May Collect About You and How It is Collected

We may collect several types of information from you and about you when you download, access and use the App.  It is either provided by your Employer, or by you through the completion of data forms, or automatically as you navigate through the App.  This may include the following types of information:

  • Personal or Sensitive Data by which you may be personally identified, such as name, address, mobile number, authentication information or other personal and sensitive information or metadata permitted by and requested by your Employer that you voluntarily provide by filling out free text fields or that you select to upload from your photos or other stored files.
  • Location Data is limited to the capture of your accurate, real-time location when you are using the App. We do not capture background location information.
  • Usage Data about your access to and use of the App, such as usage logs and other communication data and the resources that you access and use on or through the App and/or; About IP addresses or your internet connection, and information automatically collected through cookies. A “cookie” is a small text file that websites store on your computer or device to remember information about your visit, such as your preferences or login details, used for a smoother and more personalized experience. It may be possible to refuse to accept cookies by activating the appropriate setting on your device. However, by doing so, you may be unable to access certain parts of our App.
  • Device Information about the equipment you use to access the App, including your mobile device type, operating system, mobile network information, and the device’s telephone number, the IP address, internet connection and browser type if accessing the browser version of the App, and unique device identifiers that help facilitate proper functioning of the App.

If you do not want us to collect this information do not download the App or delete it from your device.

Third-Party Information Collection

When you use the App or its content, certain third parties associated with your device may use automatic information collection technologies to collect information about you or your device. We do not control these third parties’ tracking technologies or how they may be used. These third parties may include:

  • Advertisers, ad networks, and ad servers.
  • Analytics companies.
  • Your mobile device manufacturer.
  • Your mobile service provider.

These third parties may use tracking technologies to collect information about you when you use this app. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the provider responsible directly. For information about how you can opt out of receiving targeted advertising from many providers, see “Your Choices About Our Collection, Use, and Disclosure of Your Information” section.

How We Use Your Information:

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the App, its service functionality, and any other information, products, or services that you or your Employer request from us.
  • Carry out our obligations and enforce our rights arising from any contracts entered between your Employer and us.
  • Fulfill any other purpose for which you provide it.
  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it, or to troubleshoot issues.
  • Give you notices regarding the availability or interruption of our services.

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience for you by enabling us to:

  • Recognize you when you use the App.
  • Store information about your preferences, allowing us to customize our App according to your individual interests.
  • Speed up your searches.
  • Estimate our audience size and usage patterns.
  • We may use aggregated and anonymized (not identifiable) data to analyze app usage patterns and improve the overall user experience.

Disclosure (Sharing) of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual or device without restriction.  We do not sell or rent personal information collected through the App.

In addition, we may disclose personal information that we collect, or you provide:

  • To contractors, service providers, and other trusted third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our App users is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • To comply with any court order, law, or legal process, including responding to any government or regulatory request.
  • To enforce our rights arising from any contracts entered between you, your Employer and us and for billing and collection.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of The Company, our customers, or others.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide us with. This section describes the mechanisms we provide for you to control certain uses and disclosures of over your information.

  • Tracking Technologies. You can set your browser or mobile device to block or refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly.
  • Location Information. You can choose whether to allow the App to collect and use real-time information about your device’s location upon installation of the App or through the settings on your device. If you block the use of location information, some parts of the App may become inaccessible or may not function properly.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.

Accessing and Correcting Your Personal Information

Any requests to change your personal information are to be directed to your Employer, who manages your personal information on our primary Homecare GPS Website Application of which the App is a companion to.

You may direct any request to deactivate your account to your Employer who creates and manages your permitted use of the App.

Children Under the Age of 18

The App is not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information either from or about a child under 18, please contact us at (800) 214-4004.

California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information.

Visiting the Site from outside the United States (US).

The App is operated in the US. This Privacy Statement is intended to cover the collection of information within the App from US residents only. If you are located outside of the US, please be aware that any information you provide to us will be transferred to the US. By using the App, participating in any of our services and/or otherwise providing us with your information, you understand and agree that your information may be moved to, accumulated and processed in the US where our servers are located and our central database is operated and such information may be transferred to our third parties with whom we share such information as described in this Privacy Statement.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.  To learn more about consumer privacy rights in other states and how to exercise them, please visit your state’s website. How We Protect Your Information

We have implemented measures designed to protect your PII from accidental loss and from unauthorized access, use, alteration, and disclosure. All the information you provide on the App is encrypted in transit and stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. You are responsible for keeping your username and password confidential and using the App in a confidential manner, away from public or unauthorized view. We ask you not to share your password with anyone, and to sign out once you are finished.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Changes to Our Privacy Policy
